I recently was bumped into in my parking lot and am trying to settle with their insurance company for how much the repair fee would be. I took it to one place and it was around $2100 with damage to both the front and back door (they said the front door would need to be replaced). I spoke with their insurance company and they said I needed to take it to their place to have an estimate. I took it to their place, and the guy asks me if I was going to have it repaired their or somewhere else. I told him I would get it repaired somewhere else, which meant I would get a check he told me. He inspected it and told me that there was a 50-50 chance it would need to be replaced on the front door so his estimate was only for $1300. He said if I go get it fixed and they say it is more, that their insurance will pay the difference. This sounded to me like they are trying to say if you want the cash you only get $1300. What should I do? Should I try to negotiate with their insurance company for the difference or get more estimates that say I would need the new door? I would like the check, but I feel like I am getting ripped off since it would take more to actually fix it more than likely.

Minor car accident (not at fault) - should I go to my insurance or small claims court?

I was wondering if anyone could give me some advice. Last week I was involved in a minor car accident. I was at a stop light and the car behind me decided they could not wait and they tried to get by my car to make a left turn. They did not have enough room and scraped against my car with theirs. No one was hurt and no police were called. We pulled over and I got their name, phone number and address. They did not give me their insurance information and said they'd like to settle outside insurance because there are only scratches. I know it was stupid but I said okay. Also I do not have the license plate number of the car. I thought I wrote it down but I did not (I understand this is a big mistake on my behalf). We made contact over phone throughout the week and discussed repairs but suddenly they stopped answering my calls. I believe they are avoiding me. Now I am at a loss of what to do. Should I take this issue up with my insurance (at the risk of raising my premiums) or should I take this to small claims court? In either case I do not have the car's license plate so if it isn't their car will that be insufficient evidence to prove they are at fault (my word against theirs)? From what I understand, if a claim had to be filed, I would receive the current value of an item. For instance, I have a pair of $500 shoes. They are currently priced at $450, so the pay-out would be $450 and $500, correct?. Okay, so here are my two questions: 1) Would I be bound to REPLACE the lost item? Or would they give you the current cash value to buy whatever it is that you wanted to buy? 2) Are there no such policies that exists out there: a policy that would pay you what you INITIALLY paid for an item? Let's say for the sake of argument that my car is valued at 2000.00 at the beginning of this year and my full coverage insurance on this vehicle is 500.00 a year. Will having a sports car or more high-end car affect it really dramatically or will it not make that big a difference as long as my driving record stays good? Also, how much more does it cost to maintain and repair a car like a used BMW than it does just a normal car like an Accord? I've always heard that European cars in particular can be temperamental and finicky if not maintained properly, so I'm just worried that I won't have the money and know-how to have and keep a car like that as my first car.
