I called them up and asked why they were quoting me that rate and they said it was because of my age and credit score. I was involved in a fender bender where no party admitted fault. Other persons insurance company went to arbitration against my insurance company to recover their loss. Arbitration Panel decided in our favor i.e. I am not at fault hence need not pay the damages. Total loss amount listed by other party was $800. My car did not have any damage worth repairing. (Also, I am lazy and passive enough to not pursue too hard for a minor dent.) After arbitration settlement other person filed a lawsuit against me in small claims court. I was pretty sure that a judge cant do anything after arbitration. To my surprise judge assessed that out of $800 - $250 was the deductible paid by other person. Prior Arbitration did not include that amount hence he can adjudicate on this $250. He adjudicated against me for $250 + legal fee. Judge also told me that I need not worry about this money as my insurance will pay for it. (Most ridiculous judge and judgment I have ever seen, but thats a separate matter) I called up my insurance company. They are willing to pay this amount. My question is will making them pay increase my insurance premium. I have a pretty clean record with no at-fault accidents. I pay about $1000 per year for two cars in WA state. Car Insurance Company Refuses to Insure my Brother!?

So, my brother got into a car accident about 3 years ago. He was driving his car and a motorcyclist ran into him doing around 90 mph, causing the bike to flip and the guy on the bike to dismount and skid across the freeway. The motorcyclist was lucky he didn't get run over or killed. It was deemed by both the insurance companies that it was the motorcyclists fault and when the motorcyclist tried to sue our insurance company, we got a letter from our attorney that the case had been dismissed and no further action was needed. Today, we got a call out of the blue from Mercury saying my brother couldn't be on the insurance anymore because they had settled with the motorcyclist for $100,000 and basically, if we didn't get him off the insurance, my whole family would be removed. We didn't receive any notification that Mercury was planning on paying this guy out or that our rates would be altered. We called the attorney's office but he wasn't in and we explained the situation and the receptionist said they might of just settled anyway without letting us know even though this whole thing wasn't even my brother's fault. My question is, if the accident was the fault of the motorcyclist and when the motorcyclist initially sued and was denied a settlement (there was no mention of a settlement on the attorney's letter; it just said that it was dismissed), how and why would Mercury give this jacka$$ $100,000 and deny my brother coverage? It's all very confusing and any insight would be greatly appreciated. Thanks!

First off I am in CA and the other liable insurance is Farmers or 21st century. For some reason Farmers is handling the claim. Ok, so I was in an accident in which the other party was at fault. As such their insurance has accepted liability. I have already taken my car get an assessment by one of their representatives at a repair place. But do to their stupidity in a few instances, its taking a long time for them to make a decision as to repair my car or call it a total loss. So because of that, in the mean time I am forced to drive my car which I do not feel comfortable driving in. The passanger seat belt doesn't work so I can't commute to school like I usually do. Bottom line is a have been patient when they did their investigation and everything, but its been a while now and my car is still not even in a shop to get fixed. In order to maybe speed up the process and make me feel safer, can I just get a rental car already force the other insurance to pay? After all they are completely liable since it was their driver that was at fault. Why do I have to wait day after day, driving a ruined car, while they take their sweet time making their BS decisions? I know that they legally have to pay for a rental while my car gets repaired, but again they are taking time simply deciding if its a loss or not. So because of them, its not in a shop just yet...., but can I still get a rental car early and have them pay anyway? Maybe that will make em hurry up.

I was in a car accident 4 days ago. My Mother was the passenger in my car (I was driving). I was on the off ramp getting off the freeway. All cars behind me were stopped. I was stopped waiting to make a right turn. An emergency vehicle was coming in my direction from my left. Therefore, I was waiting for the emergency vehicle to pass. The person behind me (large dodge ram truck I am in an '08 2 door Infiniti coupe) thought I went so he 'gunned it' to get in front of the emergency vehicle. Unfortunately, we had not gone so he pushed my vehicle out in front of the emergency vehicle. Luckily, I was able to turn my car out of the way. I did not hit anyone (no one was in front of me). My Mother and I were both put into a gurney and taken to a local hospital in an ambulance. We both had our seat belts on and suffered whiplash. We were released 5-6 hours later after x-rays, etc. We were both prescribed medicine. My Mother has had 3 brain tumors and has trouble with her speech etc. and any violent startling trauma can get her shaken up pretty badly and confused. I know she hit her head but, she is in pain but not nearly as much as I am. With my Mother's condition I don't know if this kind of thing can have negative effects later on. I know that my neck and back is pretty messed up. It hurts to stand for after 15 minutes or so. My car is pretty messed up and had to be towed. I plan on taking it back to the Infiniti shop to get all new parts. My car has all the upgrades in it so I want it to be taken care of. Am I allowed to take it to the Infiniti dealership or will Geico (the other persons insurance) not allow that, or does it not matter? The police gave the guy that hit us a citation. I have USAA and the other person has Geico. I just want to know exactly what to do in this situation. Since I'm out a car (I work for myself) I have been out (already) a decent amount of money for not being able to meet up with my clients. I spoke to my insurance today and they said that all my medical is covered since I had that already in my plan (without it raising my premium) and that I should get a settlement ON TOP of paying for damages to my car and getting me a rental, etc. Any advice would be greatly appreciated. I don't want to get taken for a ride. I've heard the horror stories of dealing with insurance companies. Cancelling M&S Car Insurance?

Basically I took at a M&S car insurance plan for my car. A guy crashed into me whilst on a roundabout (my right of way) and his insurance have since accepted responsibility for the accident.I am now wanting to cancel the insurance as they have been very unhelpful throughout the whole process. I am just wondering how much I am going to have to pay to cancel the policy- As I was spreading the cost with agreed monthly payments the total cost including interest was 738. I did a one off payment of 101.87 and then so far have paid 4 installments of 57.89. As I have had the policy for 4 months. In the t's & c's on the website it says this: If you cancel your policy within 12 months of the Policy Start Date, we will calculate the cost for the period of cover based on our short period rates in force when we receive the Certificate of Motor Insurance and refund any excess premium you have paid. If we cancel, the premium will be calculated in proportion to the period of cover provided and we will refund any excess premium which you have paid when the Certificate of Motor Insurance has been returned to us As I have had the policy for 4 months how much will I have to pay to cancel (even the the whole process was not my fault!).just want to buy a new car and insure with somebody else! I was told by my car insurance that my car was totaled, and would only be good for parts. It was in a MINOR flood, and I called to have it evaluated. They said water was in the motor, fuse boxes, everything was ruined supposedly. I knew they were lying, because I had my fiance check it all out, and there wasn't a drop in it except for the carpeting. I told them so, and said I wanted the car back to fix it myself, but the adjustor said they already paid my bank for the damage (not even the full amount, they came up with about 45% of the payoff amount, but it was worth what I owed on it). They said if I wanted it back, I would have to give them $2,700 for the car. I said to hell with it, and had to come up with 2,600 to pay off the remaining part of the loan, and then go buy another car. Last year, I seen my car in the next town over. Same vin number, same paint chipped bumper, same fist mark behind the passenger door. I was mad, but blew it off. Then, I seen it on a buy sell trade site and decided to inquire about the details. The guy bought it for $800 and didn't have to fix anything on it except for what I needed to fix before the flood (window regulator, wheel baring, and new tires). He told me he thought I had committed insurance fraud to get a pay out from them. So, I called my old insurance company, and the lady took all my information down and gave me the adjustor's number, the adjustor's supervisor's number, and the fraud department's number. I called the adjustor, left a message, and then filed a claim with the fraud department. They said to expect a call from them next week. What exactly happens in a case like this?? I don't expect a hefty payout or anything, but still, I've never known anyone who had this happen to them, but I do know people who committed insurance fraud. They get into huge trouble and pay out fines, but what if its the INSURANCE that commits fraud? Thanks!!

I got in an accident that I am not in fault. Basically I was stopped at the intersection behind the red lights. My car is a 1994 Lexus ES300 with 125,000+ miles on it. I would say it is in good or fair condition, the leather seats are cracking badly and it has a few scrathes, etc. I'm just wandering if it is in my best interest to repair this car or for it to be totaled out. The estimate for repairs in $3500.00, which could always go up once repairs start for unseen damage. I'm just not sure the car is worth repairing for that amount considering its condition. The damage is to the drivers side rear panel which is now rubbing something when I turn either way or go over any kind of bump in the road. The estimate does not consider repair for that since that could not be seen by looking at the vehicle. They are also saying the paint can't be matched perfectly because of the fading caused by sun and weather over the years. With everything considered my resale value is not good. Last week, I had my husband's car parked up at work and I was notified that our car was broken into. The passenger side window was smashed and the thief took our GPS unit. The repair for the window cost 240 and the unit itself would be about 500. While thinking about the idea of an altruistic, fair public option for health insurance, I started trying to figure out why something like it doesn't already exist. (Or maybe it does?) The assumption seems to be that health insurance companies are causing problems through systematic greed, and the public option would help keep them honest. But, if this is the case, why isn't there an organization doing this already? Why don't the good, people, such as the ones that take less-pay than they could in other sectors to run major charitable organizations, start a good health insurance company that doesn't do any of the bad things that the other insurance companies do. If such an organization were to exist, it seems that everyone would switch to it, and even the most greedy of insurance companies would have to become like it in order to compete. There are obviously enough qualified and caring people out there to make such an organization happen without any government involvement. So why dont such organizations exist? I have a few ideas, but they dont explain the whole story. Maybe the fact that people dont usually shop around for health insurance because its chosen by their employers prevents new good insurance companies from gaining the market share required to make the bad ones change? Maybe health insurance companies are already as good as they can be, despite a few heartless employees, and the primary problems in health care come from somewhere else? Maybe protectionist legal policies prevent altruistic organizations from freely forming? Any thoughts?

His insurance already told me they are taking liability and will pay both drivers' damages, but he said that California minimum liability is only $5000, so they are planning to divide the $5000 to cover both drivers. However the damage in my car and the other guy's car exceeds $5000. I thought the limit if indeed is $5000 it should be $5000 for each driver and not for both. What do you think? One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. I have not noted anything at all and plan to stay away from all other parties. Should I change my running route? Thanks for any advice. Our 30 day clock is ticking.

Hi there, My mom was rear ended by an uninsured motorist while driving my car. I have uninsured motorist coverage and AAA estimated the damage to be approximately $1000. I own my car (it's paid off) and I would rather buy the bumper and someone I know replace the bumper, rather than go to the body shop of AAA's choice. AAA does not want to give me a check and is saying they want to pay a body shop to do it. Can they do this? I've had epilepsy since I was 5 years old, I'm now 24. I came across a comment on a website a few minutes ago about there being some kind of federal law where it's ILLEGAL to deny someone coverage because they may be in poor health, overweight, etc... aka having a pre-existing condition . If this is true about there being a law AGAINST it, why are SO MANY health insurance companies allowed to deny people w/ pre-existing conditions right off the bat? There are THOUSAND upon thousands, if not MILLIONS, of people in the U.S that have some kind of pre-existing condition, whether minor or major. So wouldn't that mean that there are THOUSANDS of insurance companies that are running their business illegally & breaking the law? Wouldn't the PPAC (Obamacare) bankrupt insurance companies?

PPAC seems very similar in nature to the Community Reinvestment Act that played a role in the 2008 financial crisis. The PPAC requires insurers to offer the same premium (price fixing) to all applicants of the same age and geographical location without regard to most pre-existing conditions (excluding tobacco use). It also states that minimum standards for health insurance policies are to be established and annual and lifetime coverage caps will be banned. As a business owner, I don't see where the government comes to the conclusion that insurance companies could survive the price fixing and taking on such high risk liabilities. It seems like 2008 all over again, does it not? Wouldn't they get involved in something similar to what the banks did with derivatives since they were forced to take on high risk loans? It seems like the big focus on Obamacare is the part where people are forced to buy insurance. I don't think that is a big issue, the big issue is how can the insurance companies handle this? Am I wrong? I am going to do more research tonight.

There was absolutely no one else coming from any of the four sides, so I might have not stopped completely but I did slow down almost to a stop and then kept going. Then like I said I was going at 36 on a 20 zone. This was at 2 a clock in the morning when there was literally not a soul around. The police officer was practically hiding in a dark, empty parking lot and came out of no where. I really don't want to make excuses for myself. I know what I did was wrong and I'll admit it. But this is my first ticket, and I really don't want t have to pay so much more money on my insurance for a slip as small as this one. My boyfriend was with mi in the car if that means anything. I've been reading up on how to get out of a ticket, and a lot of people say it is good to talk to the officer, and I thought about doing it but the officer's name is not readable at all. But the police officer wrote X Z. So my name is wrong in the ticket. I don't know if that counts for anything, someone told me that if they misspell my name or the officer's it means the ticket is dropped. HELP will my car insurance replace my cracked windshield?

I have progressive and have comprehensive with a $500 deductible. I have two cracks in my windshield and I cant afford for my insurance to go up or to pay the $500 deductible. My car was sold to me with stickers over the cracks and when we went back they claimed I had done it and wouldnt fix it. I read thriugh my policy and it said if you pay the premium for this coverage we will pay for blah blah blah and it fits my situation but im not really aure what that means. They dont teach you actual life skills in school. Please help!
