My car is a 1994 Lexus ES300 with 125,000+ miles on it. I would say it is in good or fair condition, the leather seats are cracking badly and it has a few scrathes, etc. I'm just wandering if it is in my best interest to repair this car or for it to be totaled out. The estimate for repairs in $3500.00, which could always go up once repairs start for unseen damage. I'm just not sure the car is worth repairing for that amount considering its condition. The damage is to the drivers side rear panel which is now rubbing something when I turn either way or go over any kind of bump in the road. The estimate does not consider repair for that since that could not be seen by looking at the vehicle. They are also saying the paint can't be matched perfectly because of the fading caused by sun and weather over the years. With everything considered my resale value is not good. Last week, I had my husband's car parked up at work and I was notified that our car was broken into. The passenger side window was smashed and the thief took our GPS unit. The repair for the window cost 240 and the unit itself would be about 500. While thinking about the idea of an altruistic, fair public option for health insurance, I started trying to figure out why something like it doesn't already exist. (Or maybe it does?) The assumption seems to be that health insurance companies are causing problems through systematic greed, and the public option would help keep them honest. But, if this is the case, why isn't there an organization doing this already? Why don't the good, people, such as the ones that take less-pay than they could in other sectors to run major charitable organizations, start a good health insurance company that doesn't do any of the bad things that the other insurance companies do. If such an organization were to exist, it seems that everyone would switch to it, and even the most greedy of insurance companies would have to become like it in order to compete. There are obviously enough qualified and caring people out there to make such an organization happen without any government involvement. So why dont such organizations exist? I have a few ideas, but they dont explain the whole story. Maybe the fact that people dont usually shop around for health insurance because its chosen by their employers prevents new good insurance companies from gaining the market share required to make the bad ones change? Maybe health insurance companies are already as good as they can be, despite a few heartless employees, and the primary problems in health care come from somewhere else? Maybe protectionist legal policies prevent altruistic organizations from freely forming? Any thoughts?

My stance on insurance is this: You might not have full coverage, they'll try to weasel out of paying you AND you might go for years without getting into an accident. His insurance already told me they are taking liability and will pay both drivers' damages, but he said that California minimum liability is only $5000, so they are planning to divide the $5000 to cover both drivers. However the damage in my car and the other guy's car exceeds $5000. I thought the limit if indeed is $5000 it should be $5000 for each driver and not for both. What do you think? The business I have worked at for 3 years has just announced they are shutting their doors at the end of the month. Shouldn't I try to claim all I can on car insurance?

Someone didn't quit stop on time and hit me a little in the rear. This guy was in his early 20's and when I asked for insurance he said he doesn't have it with him and that he is driving his grandmothers car. I asked him for his phone number in case there is a problem. My car just has a few marks from this but bodywork is expensive and it wouldn't surprise me if it wouldn't cost $300.Since my car is 12 years old I may not get the work done.Usually insurance companies tell you to get an estimate and mail a check to you. The driver that hit me said he is sorry but I think he hopes he doesn't owe me anything for this. Shouldn't people try to claim any amount of damage through insurance even if it is minor?

One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. I have not noted anything at all and plan to stay away from all other parties. Should I change my running route? Thanks for any advice. Our 30 day clock is ticking.

Hi there, My mom was rear ended by an uninsured motorist while driving my car. I have uninsured motorist coverage and AAA estimated the damage to be approximately $1000. I own my car (it's paid off) and I would rather buy the bumper and someone I know replace the bumper, rather than go to the body shop of AAA's choice. AAA does not want to give me a check and is saying they want to pay a body shop to do it. Can they do this? I've had epilepsy since I was 5 years old, I'm now 24. I came across a comment on a website a few minutes ago about there being some kind of federal law where it's ILLEGAL to deny someone coverage because they may be in poor health, overweight, etc... aka having a pre-existing condition . If this is true about there being a law AGAINST it, why are SO MANY health insurance companies allowed to deny people w/ pre-existing conditions right off the bat? So wouldn't that mean that there are THOUSANDS of insurance companies that are running their business illegally & breaking the law? PPAC seems very similar in nature to the Community Reinvestment Act that played a role in the 2008 financial crisis. The PPAC requires insurers to offer the same premium (price fixing) to all applicants of the same age and geographical location without regard to most pre-existing conditions (excluding tobacco use). It also states that minimum standards for health insurance policies are to be established and annual and lifetime coverage caps will be banned. As a business owner, I don't see where the government comes to the conclusion that insurance companies could survive the price fixing and taking on such high risk liabilities. It seems like 2008 all over again, does it not? Wouldn't they get involved in something similar to what the banks did with derivatives since they were forced to take on high risk loans? It seems like the big focus on Obamacare is the part where people are forced to buy insurance. I don't think that is a big issue, the big issue is how can the insurance companies handle this? Am I wrong? I am going to do more research tonight.

The police officer (whose name I can't even read on the ticket because it is just a scribble) gave me a ticket for speeding and failure to stop at a stop sign. I have always been a great driver, I never speed, I always stop at stop signs, I don't drink/text/talk over the phone and drive, I always have my seatbelt on. This one time I absolutely needed to get home at 2am I decide to go a little faster and yup, of course I get a ticket. I don't want to lie, I was doing 36 on a 20 zone at the time, I admit it even though I honestly did not realize I was going at 36 I didn't' do it on purpose. I didn't think hey I'm just gonna go faster because no one is around , I really honestly did not notice I was going at 36. But I am not sure about the stop sign thing. Honestly I was not paying much attention because I drive through this stop sign everyday but I distinctly remember there was a car already at the stop sign coming from the left so I HAD to stop. There was absolutely no one else coming from any of the four sides, so I might have not stopped completely but I did slow down almost to a stop and then kept going. Then like I said I was going at 36 on a 20 zone. This was at 2 a clock in the morning when there was literally not a soul around. The police officer was practically hiding in a dark, empty parking lot and came out of no where. I really don't want to make excuses for myself. I know what I did was wrong and I'll admit it. But this is my first ticket, and I really don't want t have to pay so much more money on my insurance for a slip as small as this one. My boyfriend was with mi in the car if that means anything. I really don't know, I've never had a ticket before. I've been reading up on how to get out of a ticket, and a lot of people say it is good to talk to the officer, and I thought about doing it but the officer's name is not readable at all. He also completely misspelled my name. In Puerto Rico we use both my father's and mother's last names so I have two last names. Let's say my name is X, my father's last name is Y and my mother's is Z. In Puerto Rico it goes like X Y Z and since my license is from Puerto Rico that is how it is written in my license. But the police officer wrote X Z. So my name is wrong in the ticket. I don't know if that counts for anything, someone told me that if they misspell my name or the officer's it means the ticket is dropped. This seems unlikely but hey, like I said I really have no clue. Again, I don't want to make excuses for myself, but I just can't afford extra insurance costs. I just cant...
